Terms and Conditions

1. Introduction and Acceptance

These Terms and Conditions ("Terms"), in accordance with Section 1751 et seq. of Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter referred to as the "Civil Code"), govern your use of the services provided by Pediatric Interventions ("PI", "we", "us", or "our"), a sole proprietorship operated by Dita Chapman.

By registering for our services, you ("Client", "you", or "your") agree to be bound by these Terms. If you do not agree to these Terms, please do not register for or use our services. These Terms form an integral part of the contract between you and Pediatric Interventions.

2. Description of Services

2.1 Nature of Services

Pediatric Interventions conducts business on the basis of and within the scope of its trade license as a sole proprietorship. We provide educational and supportive services to families of children with developmental differences, including autism, ADHD, and other neurodevelopmental conditions. Our services focus on helping families understand how biological, lifestyle, and environmental factors may relate to their child's daily functioning. Pediatric Interventions also works with adults, including couples planning to conceive, pregnant and breastfeeding women, adults with ADHD or other formally diagnosed conditions, as well as adults who simply want to take better care of their health.

Our Approach: Our educational approach is based on principles of functional medicine, which focuses on identifying nutritional, biochemical, environmental, and lifestyle factors that may influence your child's development and wellbeing. This educational perspective complements, but does not replace, conventional medical care.

Important Notice: Pediatric Interventions does not provide medical diagnosis or treatment. Our services are educational and supportive in nature and are not a substitute for medical care. Clients are encouraged to work with their licensed healthcare providers for all medical decisions. The outputs and guidance you receive are informative, educational, and recommendatory in nature, and do not constitute medical diagnostics or the provision of health care.

2.2 The PI Development Program

Our PI Development Program operates on a monthly membership basis and includes:

2.3 Functional Laboratory Testing

Functional laboratory testing is a required component of the PI Development Program. During your intake consultation, we will recommend specific tests based on your child's needs.

Important Points About Lab Testing:

Insurance: Functional laboratory tests are not covered by health insurance. All lab costs are paid directly by you to the laboratory. Neither Pediatric Interventions nor the laboratory providers file insurance claims or paperwork for these tests.

Test Limitations: The functional laboratory tests we recommend are developed and validated by the laboratories themselves. These tests measure biological markers but clinical utility (diagnostic value) has not been fully established for many functional tests. Test results should be interpreted as educational information about your child's biochemistry, not as medical diagnoses. Not all functional tests are cleared or approved by regulatory agencies (FDA in US, EMA in EU). Individual test results do not demonstrate absolute positive or negative predictive values for any disease or condition. These tests are for educational and informational purposes. Always discuss results with your child's qualified healthcare provider before making health decisions.

Test Kit Expiration: Laboratory test kits may have expiration dates. Once you receive a test kit, process it as soon as possible according to the laboratory's instructions. Expired test kits cannot be processed and the laboratory will not provide refunds for expired kits.

Health Coach Collaboration: Educational interpretation of your laboratory results is provided in collaboration with a certified health coach partner (Total Wellness Empowerment Inc, United States). By agreeing to these Terms, you consent to the international transfer of your health data to our health coach partner for educational lab result interpretation purposes (Article 9(2)(a) GDPR — Explicit Consent for Special Category Health Data). Before lab tests are ordered, you will receive and must sign a separate Health Coach Service Agreement directly with our coaching partner. Lab tests cannot be ordered until this agreement is signed.

2.4 Lab Testing Liability and Responsibilities

When we recommend and order functional laboratory tests on your behalf, you enter into a direct contractual relationship with the laboratory provider (Vibrant Wellness or Nordic Laboratories). We act solely as a facilitator to coordinate the ordering process.

PI's Role: We recommend appropriate tests based on educational assessment, coordinate ordering and logistics, and provide educational interpretation of results. We do NOT guarantee test accuracy, timing, or outcomes and are NOT responsible for laboratory errors, delays, or issues.

Laboratory Responsibility: The laboratory provider is responsible for test accuracy and quality, sample processing and analysis, timely delivery of results, their own terms of service and privacy policies, and customer service regarding technical testing questions.

Your Responsibility: You are responsible for reviewing and accepting the laboratory's terms of service, paying the laboratory directly for all tests, following sample collection instructions, contacting the laboratory directly for any testing-related issues, and understanding that test results should be discussed with your licensed healthcare provider.

Limitation of Liability: Pediatric Interventions, Dita Chapman, and associated parties shall not be liable for any issues arising from laboratory testing, including but not limited to lost or damaged samples, incorrect results, delayed processing, adverse reactions to testing procedures, or any other laboratory-related problems. All claims related to testing must be directed to the laboratory provider. Our interpretation of laboratory results is provided for educational purposes only and does not constitute medical diagnosis or treatment.

2.5 Free Initial Consultation (Optional)

Before committing to the program, you may book a free 30-minute introductory consultation to discuss your situation and determine if the PI Development Program is appropriate for your family.

2.6 Telehealth Technology Requirements

Computer Required: Our client dashboard and consultation platform are designed for desktop and laptop computers only. The client dashboard is not compatible with mobile devices (smartphones or tablets) and will not function properly on mobile browsers.

Required Technology:

You are responsible for ensuring you have access to a compatible computer and adequate internet connection before purchasing our services. If you do not have regular access to a desktop or laptop computer, our services may not be suitable for you.

Recording: Consultations are not routinely recorded. If we need to record for quality assurance or training purposes, we will request your explicit consent. You may not record consultations without our prior written permission.

Limitations of Telehealth: We cannot provide hands-on physical assessments and rely on information you provide and share with us. In case of technical failure, we will attempt to continue via phone or reschedule. You may decline telehealth services at any time, though declining means you cannot participate in our program as we do not offer in-person services.

2.7 Communications and Notifications

By registering for our services, you consent to receive communications from us via email to the address you provide and messages through the client dashboard. We may send service-related announcements, administrative messages, appointment reminders, support plan updates, and important changes to Terms or Privacy Policy.

Important: Email and dashboard messages are not monitored 24/7 and should never be used for urgent or emergency communications. See Section 7.4 (Emergency Situations) for guidance on emergencies.

2.8 Service Availability and Maintenance

While we strive to provide uninterrupted service, we do not guarantee that our services will be available at all times without interruption, that our website or client dashboard will be error-free, or that defects will be corrected immediately. We may perform scheduled or emergency maintenance that temporarily makes services unavailable. We will provide reasonable notice of scheduled maintenance when possible, but emergency maintenance may occur without advance notice.

3. Membership and Billing

3.1 Monthly Membership Fee

The monthly membership fee for the PI Development Program is €150 per month.

VAT Status: Pediatric Interventions is not a VAT payer. All prices are stated without VAT as we are not subject to VAT registration requirements.

3.2 Payment Processing

All payments are processed securely through Stripe. By registering for our services, you authorize us to charge your payment method on a recurring monthly basis.

3.3 Billing Cycle

Your billing cycle begins on the date you first register for the program. You will be charged automatically on the same day each month thereafter until you cancel your membership.

3.4 Failed Payments

If a monthly payment fails, we will attempt to process the payment again. If payment cannot be processed after reasonable attempts, your access to services may be suspended until payment is received.

3.5 Scheduling and Attendance

Your monthly membership includes one 60-minute consultation per month. It is your responsibility to schedule your consultation through our booking system. You may schedule, cancel, or reschedule your consultation at any time without penalty.

If you do not schedule or attend a consultation in a given month, the consultation does not automatically carry over to the following month. However, we will work with you on a case-by-case basis to accommodate your family's needs. If circumstances require, we may arrange for longer consultations or multiple sessions in a single month by mutual agreement.

3.6 Membership Pause for Unforeseen Circumstances

We recognize that unexpected life events may temporarily prevent you from participating in the program. In such cases, we offer a membership pause option to support you during difficult times.

3.6.1 Eligibility for Pause

A membership pause may be granted for significant, unforeseen circumstances beyond your control, such as serious illness, family emergencies, hospitalization, or other major life disruptions. Each request is evaluated individually. This pause option is not available for planned vacations or travel, routine scheduling conflicts, or temporary loss of interest in the program. The pause policy is a discretionary benefit intended to support clients facing genuine hardship.

3.6.2 How to Request a Pause

To request a membership pause, email dita@pediatricinterventions.com with a brief explanation of your circumstances and how long you anticipate needing the pause (typically one month). We will respond to your request within 2–3 business days.

3.6.3 Pause Terms

All pause requests are subject to approval on a case-by-case basis. While there is no hard limit on the number of pauses per year, the benefit is intended for occasional, genuine emergencies rather than routine use.

No Refund for Current Period: The pause benefit applies to future billing cycles only. No refunds are provided for services already paid for the current month.

Once approved, your regular monthly payment (€150) will be suspended for the approved pause period and billing will automatically resume at the start of your next billing cycle. You will retain full access to the client dashboard, educational materials, and support plans during the pause. Scheduled consultations will not take place during the pause period.

3.6.4 Automatic Resume of Services

At the end of your approved pause period, your membership and billing will automatically resume on your next regular billing date. If your circumstances change and you need to extend the pause, please contact us as soon as possible.

3.6.5 Extended Pauses

If you require a pause longer than one month, please discuss this with us when making your initial request or as soon as you become aware of the extended need. We are committed to working with you to find a solution that supports both your needs and the continuity of your child's care.

3.6.6 Right of Refusal

Our therapist reserves the right to deny pause requests that do not meet the criteria of unforeseen circumstances, limit frequent or repeated pause requests, or suggest formal cancellation if pauses become a regular occurrence. Our goal is to support clients in genuine hardship while maintaining the integrity of the program for all families.

3.7 Scheduled Absences

Planned absences (such as vacations) will be announced at least 30 days in advance whenever possible. We will work with you to schedule consultations before or after the absence period.

3.8 Service Interruptions and Therapist Availability

Pediatric Interventions is currently operated by a single therapist (Dita Chapman). In the event that the therapist is unable to provide services due to illness, injury, family emergency, or other incapacitating circumstances lasting more than two weeks (constituting a temporary impossibility of performance under Section 2006 of Act No. 89/2012 Coll., the Civil Code), we will:

3.9 Payment Disputes and Chargebacks

If you have any concerns about a charge or wish to dispute a payment, please contact us directly at dita@pediatricinterventions.com before initiating a chargeback. All payments are processed through Stripe and payment disputes are handled according to Stripe's dispute resolution procedures. By using our services, you agree to Stripe's Terms of Service.

4. Cancellation and Refunds

4.1 Your Right to Cancel

You may cancel your membership at any time without providing notice or reason. There are no cancellation fees. This right is guaranteed under Section 1829 of Act No. 89/2012 Coll., the Civil Code (withdrawal from distance contracts).

4.2 How to Cancel

To cancel your membership, use the cancellation function in the membership section of your client dashboard or contact us at dita@pediatricinterventions.com.

4.3 Effect of Cancellation

4.4 No Refund Policy

We do not provide refunds for past consultations or services that have already been rendered. If you are dissatisfied with our services, please contact us to discuss your concerns before canceling.

Technology Compatibility: Refunds are not provided due to technology incompatibility that was disclosed in our Terms. Our platform requires a desktop or laptop computer (see Section 2.6). Mobile device incompatibility is not grounds for a refund.

4.5 Suspension or Termination by PI

We reserve the right to suspend or terminate your membership if you breach these Terms, provide false or misleading information, engage in abusive or threatening behavior toward our staff, or if we reasonably determine that continuing services is not in your best interests or ours. If we terminate your membership for cause, you will not be entitled to a refund.

5. Your Responsibilities

5.1 Accurate Information

You agree to provide accurate, complete, and current information during registration and throughout your participation in the program, and to update this information as necessary.

Testing of Minors: If you are ordering laboratory tests for a minor child, you represent and warrant that you are the parent or legal guardian, you have the legal authority to consent to laboratory testing on behalf of the child, the biological samples provided will be from the child identified in your account, you understand the laboratory may use deidentified samples for research purposes, and neither you nor your child will receive compensation for any research use of the samples.

Parental Authority: By ordering services or tests for a minor, you confirm that you have parental authority or legal guardianship as defined in Section 858 et seq. of Act No. 89/2012 Coll., the Civil Code.

5.2 Confidentiality of Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5.3 Participation and Engagement

The effectiveness of our educational program depends in part on your active participation, including attending scheduled consultations, providing regular updates through your client dashboard, following through with recommended functional laboratory testing, and communicating openly about your child's progress and any concerns.

5.4 Working with Healthcare Providers

You acknowledge that our services are educational and supportive in nature. You agree to continue working with your child's licensed healthcare providers, share information from our program with your healthcare team as appropriate, make all medical decisions in consultation with qualified medical professionals, and not use our educational guidance as a substitute for medical advice, diagnosis, or treatment.

Important — Supplements and Medications: Our educational program may include information about nutritional supplements, dietary changes, and lifestyle modifications. You must consult with your child's healthcare provider before starting any new supplements, making significant dietary changes, or modifying current treatments. Never discontinue prescribed medications without your healthcare provider's guidance. Report any adverse reactions to your healthcare provider immediately. We provide education and information only. The decision to implement any recommendations is entirely yours and should be made in consultation with qualified medical professionals.

We are not liable for any adverse reactions, side effects, or health consequences resulting from your use of any supplements or products we discuss. See Section 8.3 (No Liability for Supplement or Product Recommendations) for complete details.

5.5 Documents and Materials

You are responsible for any documents or materials you upload to the client dashboard. You must ensure you have the legal right to share any information you provide to us.

6. Intellectual Property

6.1 Our Content

All content provided through the PI Development Program, including support plans, educational materials, assessment interpretations, and other resources, remains our intellectual property. This content is provided for your personal, educational use only.

6.2 Restrictions

You may not use our materials for commercial purposes, modify or create derivative works from our content, or remove any copyright or proprietary notices from our materials.

6.3 Your Content

You retain ownership of any documents, information, or materials you upload to your client dashboard. By uploading content, you grant us a limited license to use, store, and process this information solely for the purpose of providing services to you.

6.4 Educational Use and Case Studies (Optional Consent)

With your separate, optional consent, we may use anonymized case information for educational purposes, including webinars, lectures, case studies, and professional training materials. This consent is entirely optional and does not affect your access to services. All case information used educationally is fully anonymized (all identifying information removed, case details modified as needed). You can withdraw consent at any time, though withdrawal does not affect information already shared in anonymized form.

7. Confidentiality and Professional Boundaries

7.1 Confidentiality

We maintain confidentiality regarding the information you share with us, subject to the limitations described in our Privacy Policy and the exceptions below.

7.2 Limits to Confidentiality

We may disclose information if required by law (e.g., court order, legal process), necessary to prevent serious harm to you, your child, or others, required by mandatory reporting laws (e.g., suspected child abuse or neglect, imminent danger), or if you provide written consent for disclosure.

7.3 Not a Therapeutic Relationship

While our services are supportive and educational, they do not constitute psychotherapy, counseling, or medical treatment. Our relationship with you is educational in nature.

7.4 Emergency Situations and Crisis Support

Not an Emergency Service: Pediatric Interventions does not provide emergency or crisis intervention services. If you or your child are in immediate danger or experiencing a mental health crisis, please call emergency services immediately (European emergency number: 112), contact your local crisis hotline, go to your nearest emergency department, or contact your child's healthcare provider.

If during a consultation or communication you disclose information suggesting immediate danger to yourself, your child, or others, we will advise you to contact emergency services immediately, fulfill any mandatory reporting obligations as required by law, and may need to pause or discontinue services until the crisis is resolved and appropriate professional support is in place.

Mandatory Reporting: We are legally obligated to report suspected child abuse, neglect, or situations where a child or individual is at imminent risk of serious harm. Such reports are made to appropriate authorities as required by Czech law and may occur without your prior consent.

Email and Message Limitations: Email and dashboard messages are not monitored 24/7 and should never be used for urgent or emergency communications. Do not use these channels to communicate time-sensitive or emergency information.

8. Limitation of Liability

8.1 Educational Nature of Services

You acknowledge and agree that our services are educational and supportive, not medical or therapeutic; we do not diagnose, treat, cure, or prevent any disease or medical condition; laboratory test interpretation is provided for educational purposes only; and all health-related decisions should be made in consultation with licensed medical professionals.

8.2 No Guarantees

We do not guarantee any specific outcomes or results from participation in the PI Development Program. Individual responses to functional medicine approaches vary, and results cannot be predicted or guaranteed.

8.3 No Liability for Supplement or Product Recommendations

Any supplements, vitamins, products, or lifestyle interventions we discuss or recommend are provided for educational purposes only. We do not manufacture, sell, or control these products. To the maximum extent permitted by law, we are not liable for adverse reactions or side effects to any supplements or products we discuss, interactions between supplements and your medications or medical conditions, quality or safety of third-party products you choose to purchase, or health outcomes resulting from your use or non-use of any recommended products.

You are solely responsible for consulting your licensed healthcare provider before starting any supplements, monitoring your own reactions, informing all your healthcare providers about supplements you are taking, and reading product labels and following dosage instructions. When we mention specific brands or products, this is for educational purposes only and does not constitute an endorsement. We receive no compensation from product manufacturers (unless explicitly disclosed).

8.4 Limitation of Damages

To the maximum extent permitted by law, Pediatric Interventions and Dita Chapman shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use or inability to use our services, any unauthorized access to our servers or personal information, any interruption or cessation of services, or any errors or omissions in any content or materials.

Exception: This limitation does not apply to liability for damages caused by intentional misconduct or gross negligence, or liability arising from breaches of GDPR (which cannot be contractually limited under Article 82 GDPR).

8.5 Maximum Liability

In any case where we are found liable, our total liability shall not exceed the amount you paid to us in the three months immediately preceding the event giving rise to liability (maximum €450 based on current pricing).

8.6 Acknowledgment

You acknowledge that the limitations in this section are reasonable given the educational nature of our services and the fees charged.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

10. Changes to Terms

10.1 Right to Modify

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting a notice on our website, sending an email to the address associated with your account, and providing notice through your client dashboard.

10.2 Your Continued Use

Your continued use of our services after changes to these Terms constitutes your acceptance of the modified Terms in accordance with Section 1752 of Act No. 89/2012 Coll., the Civil Code (amendment of contract by conduct). If you do not agree to the modified Terms, you may cancel your membership.

11. Governing Law and Disputes

11.1 Governing Law

These Terms and the contractual relationship established between you and Pediatric Interventions shall be governed by and construed in accordance with the laws of the Czech Republic, particularly Act No. 89/2012 Coll., the Civil Code, as amended.

11.2 Complaints Procedure

In accordance with Act No. 634/1992 Coll. (Consumer Protection Act), as amended, we maintain a complaints procedure for resolving client concerns. To submit a complaint, email dita@pediatricinterventions.com with the subject line "Complaint — [brief description]". We will acknowledge your complaint within 5 business days, investigate thoroughly, and provide a full response within 30 days of receipt.

11.3 Out-of-Court Dispute Resolution

Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us. If a consumer dispute cannot be resolved through direct communication, you may use the Czech Trade Inspection Authority (Česká obchodní inspekce):

11.4 Jurisdiction

Any disputes that cannot be resolved through out-of-court dispute resolution shall be subject to the exclusive jurisdiction of the courts of the Czech Republic with substantive and local jurisdiction according to Czech law.

12. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pediatric Interventions regarding the use of our services.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.

Language: These Terms are provided in English. In case of any discrepancy between different language versions, the English version shall prevail.
